What Is HOA Discrimination Under the Fair Housing Act?

The Fair Housing Act (42 U.S.C. § 3604) prohibits HOAs from discriminating based on race, color, religion, national origin, sex, familial status (having children), or disability. Discrimination includes selective enforcement against certain groups, denying reasonable accommodations for disabilities, applying different fees or rules to certain groups, and creating a hostile environment for protected class members.

Signs Your HOA May Be Discriminating

Watch for: rules enforced more strictly against homeowners of certain backgrounds, denial of disability accommodation modification requests that are granted to others, hostile comments related to protected characteristics, selective towing targeting certain residents, and children being treated differently from adults in community rules.

Step 1 — Document Everything Meticulously

Keep detailed records of every discriminatory incident — dates, times, what was said, witnesses. Save all written communications. Document how similarly situated homeowners of different backgrounds are treated. Note any comments by board members that reference your protected characteristic.

Step 2 — File a Complaint with HUD

File a Fair Housing complaint with HUD at hud.gov. You have one year from the discriminatory act to file. HUD will investigate, and if they find probable cause, will pursue the case on your behalf at no cost to you. You can also file simultaneously with your state's civil rights agency.

Step 3 — Reasonable Accommodations for Disability

If you have a disability, the HOA must provide reasonable accommodations — changes to rules, policies, or practices — necessary to give you equal opportunity to use and enjoy your home. Refusal to provide a reasonable accommodation is itself a Fair Housing violation.

Step 4 — Consult a Fair Housing Attorney

Fair Housing cases can result in actual damages, emotional distress damages, punitive damages, and attorney fees paid by the HOA. Many Fair Housing attorneys work on contingency. Contact the National Fair Housing Alliance for referrals to attorneys who handle HOA discrimination cases.
