How HOA Fine Limits Work

Can an HOA fine be unlimited?

No. Most states have statutes that require fines to be "reasonable." Furthermore, states like Florida and Virginia have hard caps. If your fine exceeds these, it may be legally unenforceable.

Even in states without a specific dollar cap, the board must follow "due process." This includes giving you written notice and offering a hearing before the fine is finalized.

What if my state has no cap?

In states without specific statutory caps (like Texas or Georgia), the HOA is still bound by the principle of "reasonableness" and must follow the specific fine schedule outlined in their governing documents.

If your HOA imposes an astronomical fine (e.g., $500 for a single blade of grass), a court will often strike it down as an illegal penalty, even if state law doesn't specify an exact limit.
